Welcome to Bostie Bubbles. These Terms of Service (“Terms”) govern your access to and use of www.bostiebubbles.com (the “Site”), including your purchase of products and participation in subscription programs offered through the Site.
The Site and Bostie Bubbles are operated by Cristebra 15 LLC (“Bostie Bubbles,” “we,” “us,” or “our”).
By accessing or using the Site, creating an account, placing an order, or purchasing a subscription, you agree to these Terms. If you do not agree to these Terms, please do not use the Site or purchase our products.
1. Eligibility
By placing an order or purchasing a subscription, you represent that you have the legal capacity to enter into a binding agreement or are otherwise legally authorized to make the purchase.
2. United States Sales
We currently sell and ship products only to destinations within the United States where shipping is made available by Bostie Bubbles. Current shipping availability is described in our Shipping Policy and may also be displayed at checkout.
Availability and shipping options may vary depending on the destination. We reserve the right to limit the geographic areas in which products or particular shipping services are available.
3. Orders
Placing an order through the Site constitutes an offer to purchase the products included in your order.
We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including because of:
- product unavailability;
- errors in pricing, product information, or availability;
- suspected fraud or unauthorized payment activity;
unusually large quantities or suspected unauthorized resale;
inability to deliver to the address provided; or
other circumstances that reasonably prevent us from fulfilling the order.
If we cancel an order after payment has been successfully processed, we will refund the amount paid for the cancelled portion of the order to the applicable payment method.
Receipt of an order confirmation does not prevent us from cancelling an order for one of the reasons described above.
4. Prices, Taxes, and Charges
All prices displayed on the Site are stated in U.S. dollars (USD) unless otherwise indicated.
Applicable sales taxes and shipping charges may be calculated and displayed during checkout based on the products ordered, shipping destination, and other relevant factors.
The total amount payable will be displayed before you submit your order.
We may change product prices at any time. Price changes will not retroactively affect orders that have already been accepted, except where required to correct an obvious pricing error.
If a product is listed at an incorrect price due to a typographical, technical, or other error, we reserve the right to correct the error and, where necessary, cancel the affected order and issue an appropriate refund.
Promotions, discounts, coupon codes, and special offers may be subject to separate eligibility requirements, limitations, and expiration dates.
5. Payments
We accept the payment methods made available at checkout.
Payment methods may be provided and processed by third-party payment service providers, such as Stripe and PayPal. Available payment methods may change from time to time.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge the amount shown at checkout.
We are not responsible for a transaction being declined or otherwise rejected by your bank, card issuer, payment provider, or other financial institution.
Additional terms apply to recurring payments associated with subscriptions, as described below.
6. Subscriptions and Automatic Renewal
Certain Bostie Bubbles products may be available through a subscription.
When you purchase a subscription, the applicable price, billing frequency, delivery frequency, and recurring nature of the subscription will be presented to you before you complete your purchase.
By purchasing a subscription, you expressly authorize Bostie Bubbles and our payment providers to automatically charge your selected payment method for each recurring order according to the subscription terms presented to you at the time of purchase.
Your subscription will continue and renew automatically until you cancel it.
Recurring Charges
You will be charged the applicable subscription price, together with applicable taxes, shipping charges, or other amounts disclosed to you, at each billing interval.
You are responsible for maintaining a valid payment method for your subscription.
Pause
You may pause an eligible subscription through your Bostie Bubbles account. While a subscription is paused, future subscription orders and recurring charges will be suspended in accordance with the options made available through your account.
You may resume a paused subscription through your account, after which future orders and recurring charges will resume according to the applicable subscription schedule.
Pausing a subscription does not automatically cancel or refund an order that was already processed before the pause became effective.
Cancellation
You may cancel your subscription through your Bostie Bubbles account using the cancellation functionality provided there.
Cancellation will stop future subscription renewals and recurring charges. We do not charge a cancellation penalty.
Cancellation does not automatically cancel or refund an order that has already been processed. Such orders are subject to our Returns & Refunds Policy and applicable law.
Subscription Changes
At launch, self-service subscription management may be limited to Pause, Resume, and Cancel. The ability to independently change products, quantities, or delivery frequencies may not be available.
Additional subscription-management options may be introduced in the future.
Changes to Subscription Terms or Pricing
We may change subscription pricing or other subscription terms from time to time.
Where a change materially affects an existing subscription, including a change to recurring pricing or other material renewal terms, we will provide notice before the change takes effect as required by applicable law.
Where required by applicable law, we will also provide applicable renewal reminders, cancellation information, or obtain additional consent before implementing certain changes.
Nothing in this section limits any subscription or automatic-renewal rights available to you under applicable state or federal law.
7. Shipping and Delivery
Available shipping methods, estimated delivery information, and applicable shipping charges will be displayed during checkout when applicable.
Shipping and delivery dates are estimates unless expressly stated otherwise and may be affected by circumstances outside our reasonable control.
You are responsible for providing a complete and accurate shipping address and other delivery information.
We are not responsible for delays or additional costs resulting from inaccurate or incomplete information provided by you, except where otherwise required by applicable law.
Questions or claims regarding delayed, lost, damaged, or missing shipments will be handled in accordance with our Shipping Policy.
8. Returns, Replacements, and Refunds
Returns, replacements, and refunds are subject to our Returns & Refunds Policy.
Cancelling or pausing a subscription does not automatically cancel or refund an order that has already been processed.
Due to the nature of our ingestible pet products and for product safety and quality reasons, products are not eligible for physical return once shipped.
If a product arrives damaged, defective, incorrect, or with its product integrity compromised during shipping, please contact us within seven (7) days of delivery. Eligible claims may be resolved through replacement, refund, credit, or another appropriate remedy, as described in our Returns & Refunds Policy.
We do not require customers to return products to us in connection with an eligible claim.
Cancelling or pausing a subscription does not automatically cancel or refund an order that has already been processed.
Nothing in these Terms or our Returns & Refunds Policy is intended to limit any rights or remedies that cannot be waived under applicable law.
9. Products and Pet Health Information
Bostie Bubbles products are intended for use in dogs only and are not intended for human consumption.
Information provided on the Site, including product descriptions, ingredient information, wellness content, articles, blog posts, directions, and other materials, is provided for general informational purposes.
Such information is not intended to replace professional veterinary advice, diagnosis, or treatment.
Our products are not intended to diagnose, treat, cure, or prevent any disease.
You should consult a veterinarian when appropriate before introducing Bostie Bubbles soft chews into your dog’s diet, particularly if your dog has an existing medical condition, is receiving medication or other products, is pregnant or nursing, or if you have questions about whether a product is appropriate for your dog.
Always follow the directions, serving information, precautions, and warnings appearing on the product label.
If your dog experiences an unexpected or adverse reaction, discontinue use and consult your veterinarian.
10. Product Information and Availability
We make reasonable efforts to display and describe our products as accurately as possible.
However, product packaging, appearance, colors, labeling, ingredients, specifications, and other product information may be updated or may differ slightly from images shown on the Site.
Nothing in this provision permits materially false or misleading product information.
You should review the label and information accompanying the product you actually receive before use, particularly if your dog has allergies, sensitivities, dietary restrictions, or other specific needs.
All products are subject to availability.
We reserve the right to discontinue products or limit product availability or quantities at any time.
11. Accounts and Account Security
Certain Site features may allow or require you to create a Bostie Bubbles account.
You are responsible for providing accurate account information and for keeping that information reasonably up to date.
You are responsible for maintaining the confidentiality of your account credentials and should take reasonable steps to prevent unauthorized access to your account.
If you believe your account has been accessed or used without authorization, please contact us promptly.
We may restrict, suspend, or terminate an account where reasonably necessary because of fraud, abuse, security risks, violation of these Terms, unlawful activity, or legal requirements.
If we suspend or terminate an account that has an active subscription or pending orders, we will address those subscriptions, orders, and any refunds or other amounts due in accordance with applicable law and our policies.
12. Intellectual Property
The Site and its contents, including the Bostie Bubbles name, trademarks, logos, designs, text, photographs, illustrations, videos, graphics, packaging designs, visual elements, product presentation, and editorial content, are owned by Cristebra 15 LLC, its licensors, or other applicable rights holders and are protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Site for your personal, non-commercial use.
Unless authorized by us or permitted by applicable law, you may not reproduce, copy, distribute, modify, publish, sell, license, commercially exploit, or create derivative works from Site content.
You may not use automated systems, scraping technologies, data-mining tools, or similar methods to systematically extract or reproduce substantial portions of the Site or its content without our authorization.
Nothing in this section is intended to prevent ordinary use by search engines, services authorized by us, or activities otherwise permitted by applicable law.
13. Reviews, Feedback, and User Content
You remain responsible for content you submit.
You may not submit content that:
- is unlawful, fraudulent, defamatory, threatening, or abusive;
- infringes intellectual property, privacy, publicity, or other rights of another person;
- contains another person’s personal information without authorization;
- contains malware or malicious code;
- constitutes spam or unauthorized advertising; or otherwise violates these Terms or applicable law.
We may moderate, reject, or remove content that violates these requirements or applicable law.
By submitting content intended for publication, you grant Cristebra 15 LLC a non-exclusive, royalty-free license to use, reproduce, display, distribute, and format that content for purposes related to operating, promoting, and improving Bostie Bubbles and our products.
You retain ownership of your original content.
Where indicated on the Site, product reviews may be limited to verified purchasers.
14. Prohibited Uses
You may not use the Site:
- for unlawful, fraudulent, deceptive, or abusive activities;
- to interfere with the security, integrity, availability, or operation of the Site;
- to introduce malware, malicious code, or harmful technologies;
- to attempt unauthorized access to accounts, systems, networks, or information;
- to impersonate another person or intentionally provide false information;
- to conduct unauthorized scraping, automated data extraction, or data mining;
- to distribute spam or unauthorized commercial communications;
- to violate the rights of Bostie Bubbles or another person or entity; or
- to purchase products for unauthorized commercial resale.
We may limit quantities or reject orders where we reasonably believe products are being purchased for unauthorized resale.
15. Third-Party Services and Links
The Site may contain links to, or integrate with, websites, platforms, payment providers, shipping providers, social media services, and other services operated by third parties.
We do not control independent third-party services, and your use of those services may be subject to separate terms, conditions, and privacy policies.
The inclusion of a third-party link or integration does not necessarily constitute our endorsement of that third party or its content.
To the extent permitted by applicable law, we are not responsible for the independent practices, content, availability, or operation of third-party services that we do not control.
16. Disclaimer of Warranties
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
WE DO NOT GUARANTEE THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM WARRANTIES REGARDING THE SITE AND SERVICES THAT ARE NOT EXPRESSLY PROVIDED BY US OR THAT ARE NOT REQUIRED BY LAW.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.
PRODUCT-SPECIFIC RIGHTS, RETURNS, REPLACEMENTS, AND REFUNDS ARE ALSO SUBJECT TO OUR RETURNS & REFUNDS POLICY AND APPLICABLE LAW.
17. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, CRISTEBRA 15 LLC, BOSTIE BUBBLES, AND THEIR OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING WHERE APPLICABLE LIABILITY ARISING FROM GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER LIABILITY THAT THE LAW DOES NOT PERMIT US TO LIMIT.
Some states do not allow the exclusion of certain warranties or the limitation or exclusion of certain damages. Accordingly, some of the limitations above may not apply to you, and you may have additional rights under applicable state law.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Cristebra 15 LLC, Bostie Bubbles, and their officers, employees, agents, and service providers from claims, liabilities, damages, losses, and reasonable costs arising out of or related to:
- your violation of these Terms;
- your unlawful or unauthorized use of the Site; or
- your violation of the rights of another person or entity.
This provision does not require you to indemnify us for liability arising from conduct for which we are legally responsible.
19. Electronic Communications
By using the Site or providing your email address in connection with an order, account, or subscription, you consent to receive transactional, administrative, security-related, and legally required communications from us electronically.
These communications may include order confirmations, receipts, shipping information, subscription notices, renewal information, pause or cancellation confirmations, account notifications, and other communications related to your relationship with Bostie Bubbles.
This consent does not constitute consent to receive marketing communications.
Marketing communications are subject to separate preferences, opt-in mechanisms where applicable, and applicable law. You may unsubscribe from marketing emails using the unsubscribe mechanism provided in those communications.
20. Force Majeure
We will not be liable for delays or failures in performance caused by events beyond our reasonable control.
Such events may include natural disasters, severe weather, carrier disruptions, transportation interruptions, supply-chain disruptions, labor disputes, governmental actions, public emergencies, utility failures, telecommunications failures, or similar circumstances outside our reasonable control.
This provision does not limit any refund, cancellation, or other consumer right that cannot be waived under applicable law.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, products, services, technology, practices, or applicable law.
When we make changes, we will update the “Last Updated” date at the top of these Terms.
Material changes will become effective in accordance with any notice requirements imposed by applicable law.
If we make material changes affecting an existing subscription, including changes to recurring pricing or other material subscription terms, we will provide notice as required by applicable law before those changes take effect.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent that applicable federal law or mandatory consumer-protection laws require otherwise.
Subject to applicable law, disputes arising out of or relating to these Terms, the Site, or your purchase of Bostie Bubbles products may be brought before courts of competent jurisdiction in Florida.
Nothing in this section is intended to deprive a consumer of any mandatory protection or right to bring a claim in another jurisdiction that cannot lawfully be waived under applicable state or federal law.
These Terms do not require mandatory arbitration.
23. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed from these Terms.
The remaining provisions will continue in full force and effect.
24. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.
Any waiver must be expressly made by us and will apply only to the circumstances for which it is given.
25. Entire Agreement and Related Policies
These Terms, together with the policies and terms expressly incorporated or referenced through the Site, including our Privacy Policy, Cookie Policy, Returns & Refunds Policy, and Shipping Policy, constitute the applicable agreement between you and Bostie Bubbles regarding your use of the Site and purchase of our products.
Where a specific policy governs a particular subject, such as shipping, returns, or refunds, the provisions of that specific policy will control with respect to that subject to the extent of any inconsistency with a more general provision of these Terms.
